This
initiative of e-registration, already being followed in some states, will
provide quick solutions to issues related to change of ownership of immovable
properties
Very soon, technological
advancements may knock at the office of sub-registrar of stamps and
registration in Uttar Pradesh for land or property registration via an online
system, which is already being followed by some other states in the country.
Mewalal Chauhan,
sub-registrar of stamps, Lucknow, says, “Presently, our office does not have an
online registration facility. Despite computerising the registration of
property documents, we are still doing it manually just like it was done in the
past. The implementation of this new technology will take time; however, it
will definitely help the system.“
Registration of documents
by any process is mandatory, so that the legal ownership is guaranteed to the
person for the piece of land or immovable property purchased. Being an agrarian
economy, properties in India are usually infested with legal issues related to
land grabbing, and eregistration seems to be a simple answer to all these legal
hassles.Devendra Garg, an advocate, informs, “E-registration will restructure
the registration of immovable properties and sim plify the process besides
thwarting illegal disposal of land. Persistent grey areas through transfer of
property under rent, power of attorney, etc. as defined under the Land
Registration Act-1925 shall be solved once e-registration starts in UP.“
As the new system evolves,
there are some discrepancies in eregistration, proffers, Sushil Balwada, an
advocate, “Some of the provisions laid down in Indian Stamp Act and
Registration Act have been violated when it comes to e-registration like in the
case of right to appeal against the valuation of property, which was available
in the Registration Act under section 47(A). To avoid legal wrangles, the
government must ensure that all loopholes are addressed properly before the
launch of e-registration.“
The process of
e-registration is simple, transparent, plugs revenue leakages and disputes are
minimised besides eliminating middlemen or touts. Advocate Garg also informs,
“E-registration helps in creating the country's database of the land records
except the wills. The biggest advantage is to the exchequer, as huge revenue
losses will be plugged by e-registration.“
